BOOKING TERMS & CONDITIONS
Please read the following terms and conditions carefully. You must not place any order unless you understand and agree to the following terms and conditions. A contract will be formed between you and us when we issue an invoice in response to your order request.
1. Tour booking
Bookings must be accompanied by a deposit of at least 30% of the total booking value, or IDR 1,000,000 for bookings of IDR 5,000,000 or less. This deposit is non-refundable unless we or you cancel the program. Full payment must be made on your departure/arrival date in Bali.
2. Prices
All prices are in Indonesian Rupiah (IDR) unless otherwise stated. Please note that prices quoted are subject to change. Price changes may occur due to factors beyond our control that increase the cost of the services we arrange on your behalf. Such factors include adverse currency fluctuations, fuel costs, taxes and accommodation increases. Prices are only guaranteed once you have paid in full. No refunds will be made in respect of accommodation, meals, activities, transport or other services included in the tour price. No refunds will be made for any reason whatsoever and even if not used by you.
3. Cancellation by you
Cancellation of a booking by you must be made in writing. We will not treat a booking as cancelled unless and until written notice is received by us. Cancellations will be subject to the following charges:
- 30 days: No cancellation fee
- 29 – 16 days: 50%
- 15 – 0 days: 100%
4. Cancellation or modification by us
Every effort will be made to run all tours as advertised, but please remember that our tours are planned in advance and due to factors beyond our control, it may be necessary to use alternative accommodation and services in some cases. We therefore reserve the right to change or cancel any tour, accommodation or arrangements at any time. We will notify you as soon as possible of any material changes. In the event of a material change or cancellation, we will (if possible) arrange on your behalf three alternatives:
- Services of an equivalent or similar standard, if available;
- Services of a lower standard together with a refund of the difference in price;
- or Cancellation with a full refund of all monies paid.
A material modification is a change that has a serious impact on your tour and includes a change of departure date, departure point or airport, or a change of departure time of more than twelve hours, which would cause significant inconvenience to you. Changes in accommodation or mode of transportation do not constitute a significant change. If there are not enough bookings to provide a particular tour, we may cancel the tour up to 30 days before the scheduled departure date, after which all monies paid by you for Nagiku Bali Tour will be refunded but no further compensation will be payable. You and Nagiku Bali Tour agree to release each other from any further liability that would otherwise be imposed if the tour is cancelled.
5. Special requests
You must let us know when you make your booking if you have any special requests or needs (such as ground floor accommodation, disabled access or special dietary requirements). We will endeavour to accommodate any requests you may have. However, we cannot guarantee that we will be able to accommodate everyone’s needs and we make no promises and cannot be responsible for any special requests that we cannot fully accommodate. If we feel that we cannot accommodate your special needs, we reserve the right to refuse your booking or ask that you be accompanied by someone who can provide full assistance to you during your tour.
6. Health
You should ensure that you are aware of the health requirements and recommended precautions relevant to your trip and ensure that you carry all necessary vaccination documentation. In some cases, failure to produce the necessary vaccination documentation may deny you entry to a country. We recommend that you consult your local doctor, travel medical service or specialist vaccination clinic before you start your tour.
7. Travel documents & behaviour
All travellers should check their travel documentation to ensure that the dates are correct, visas have been obtained and passports are valid for at least six months. Please ensure that you carefully read the invoice and other documents we send you as soon as you receive them and contact us immediately if any information appears to be incorrect. If you do not arrive on the agreed date for your tour, we may treat the tour as having been cancelled by you.
You must follow our instructions at all times and you agree to indemnify us for any loss or injury suffered as a result of your failure to comply with our instructions. You must behave yourself so as not to cause any disturbance or offence to other travellers and you agree to be responsible for any damage you cause to our property or to any third party. We will not be liable to you for any loss or damage you suffer arising from or in connection with any breach of any law at any location during the tour. You indemnify us for all third party action taken against us for any loss or damage caused by you or arising from your participation in the tour.
8. Feedback
If you are dissatisfied with any aspect of the service we have arranged on your behalf, you must report this to your tour guide so that immediate action can be taken to resolve the problem. Any feedback provided to Nagiku Bali Tour after the tour has ended must be in writing within 14 days of the tour completion. If you do not notify us in writing within 14 days, our ability to investigate negative feedback may be impaired.
9. Photography
We sometimes take photographs during our tours for use in promotional materials. Unless you tell us otherwise, you consent to the use of your photographs/videos.
10. Our role as agent
Certain services provided by third parties (including third party flights, bus and boat transport), hotel accommodation, meals and certain tour activities are arranged by us in our capacity as agent only. Our obligation is to make bookings on your behalf for such services and to arrange the relevant contracts between you and the service providers. We take care to select reputable service providers, but we have no control over, or responsibility for, the services provided by third parties. All bookings are made subject to the terms and conditions, including conditions of carriage and limitations of liability imposed by these service providers.
We can provide you with a copy of the relevant service provider’s terms and conditions on request. Your legal rights in relation to such services are against the particular service provider and, except to the extent that the problem is due to an error on our part, not against us. You acknowledge that this clause will apply to all services provided by third parties even though our tour guides may accompany you during the provision of such services.
11. Money held for operational purposes
All money you pay to us will belong to us and will become a debt payable to the travel service provider upon the provision of the services to which such money relates. You agree and acknowledge that such money will not be held by us on trust for and on your behalf and we may hold such money in any account we deem appropriate, including with our own money and/or the money of other customers.
12. Liability
Your booking is accepted on the understanding that you appreciate and assume the risks inherent in travel. These risks may be greater if your tour includes adventure or sporting activities (such as kayaking, hiking, rock climbing, white water rafting, cycling and quad or motorbike riding).
To the extent permitted by law, neither Nagiku Bali Tour nor any of its related bodies corporate, directors, shareholders, employees or agents shall be liable in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by: The act, omission or default, whether negligent or otherwise, of any third party provider over which we have no control (including but not limited to hotel, activity and vehicle operators); or any other event beyond our control, including natural disaster or force majeure, disease, epidemic, act of war, civil unrest, rebellion, animals, strikes or other labor activity, criminal or terrorist activity of any kind, overbooking or downgrading of service, food poisoning, mechanical or other failure of aircraft, automobile or other means of transportation, or failure of any transportation mechanism to arrive or depart on time.
Except in cases of death or bodily injury, our liability is limited in any event to the maximum value of your tour price. In circumstances where our liability cannot be excluded and liability can be limited by law, such as under applicable consumer law, our liability is limited to the damages we are required to pay under that law.
Subject to these terms and conditions (including ‘Our role as agent’), our liability to you for death or personal injury, if such death or personal injury is not caused by or attributable to you, is limited in accordance with applicable international conventions, including the Geneva Conventions 1973 in relation to carriage by road and the Athens Convention 1974 in relation to carriage by sea.
13. Privacy Policy
We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy. By providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy.
In particular, you agree that in certain circumstances we are permitted to disclose your personal information to overseas recipients. Such recipients may include overseas travel service providers. In most cases, these travel service providers will receive your personal information in the country where they will provide the services to you or where their business is located.
We may also disclose your personal information to our overseas related entities and to service providers who perform services for us. Generally, we will only disclose your personal information to these persons in connection with facilitating your booking and/or to enable them to perform administrative and technical services on our behalf. If we disclose your personal information to anyone (including overseas recipients), we will use reasonable efforts to ensure that the recipient complies with relevant privacy laws.
However, you acknowledge that we cannot control the privacy practices of recipients and therefore will not be responsible for how recipients handle your personal information. We encourage you to review the privacy policies of any third party service providers whose services we arrange on your behalf. When used above, “disclose” includes ‘to transfer, share, transmit, or otherwise make available to or access by another person or entity’.
14. Applicable law and jurisdiction
In the event of any dispute between you and us, the laws of Indonesia will apply. You unconditionally and irrevocably submit to the exclusive jurisdiction of the courts.
PERSONAL DATA PROTECTION
We also want to store and use your personal data for future marketing purposes (for example, sending you our marketing materials) unless you have told us that you do not want us to do so. All personal data you provide to us (including sensitive personal data) will be retained, but we will only use your name and contact details for marketing purposes. Like most websites, our website uses cookies. A ‘cookie’ is a small data file that our website server stores on your computer to collect information about your visit and remember you the next time you visit. The main purpose of cookies is to identify users and personalize their visits by customizing the web pages for their use. We may also use third parties who will not collect personally identifiable data (such as the IP address of a user’s computer) to analyze visits to the site and carry out other similar activities.
In the process, they may place their own cookies on your computer so that they can collect information about your visit. You can disable or delete these cookies through your internet browser if you wish. However, doing so may mean that you will not be able to access our website or parts of it, your experience of our website may be negatively affected and/or you may not receive information relevant to your personal interests.
We take appropriate technical and organizational measures intended to prevent unauthorized or unlawful processing of personal data and the accidental loss or destruction or damage to personal data.
You generally have the right to ask us (by letter or email) what details about you are stored or processed, for what purposes and to whom they may or have been disclosed. We will charge a fee for responding to such requests. We undertake to respond to your request within 40 days of receiving your written request and your fee. In certain limited circumstances, we reserve the right to refuse your request.
